Privacy policy
How we process the personal data you provide through this website or in the course of our business relationship, under Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).
1. Data controller
- ADVANCE Trading Solutions, s.l.u.
- Tax ID (NIF): ESB86762168
- Address: Calle Valparaíso, 2, Esc. Izda., Planta 1ª, Of. 12, 28944 Fuenlabrada, Madrid (España)
- Data protection contact: advance@advancetradingsolutions.com
- Phone: +34 910 374 500
We have not appointed a data protection officer, as none of the cases in article 37 GDPR applies. Any privacy query can be sent to the email address above.
2. What data we process and where it comes from
We only process the data you give us. We do not buy databases or obtain data from undisclosed sources.
- Professional contact details: name, company, email address, phone number.
- Project details: sector, service of interest and the description you write.
- Business relationship data: communications, quotations, orders, operation paperwork and billing data once there is a contract.
The contact form on this site does not send data to a server of ours: it opens your own email client with the message ready to send, so you keep control of the transmission and we receive an ordinary email.
3. Why we use it and on what legal basis
- To answer your enquiry and prepare a proposal: pre-contractual steps at your request (art. 6.1.b GDPR).
- To manage the business relationship and the contracted service: performance of a contract (art. 6.1.b GDPR).
- To keep commercial contact with clients and companies in the sector: legitimate interest in developing our activity (art. 6.1.f GDPR), where your rights do not override it.
- To comply with accounting, tax, customs and anti-money-laundering obligations: legal obligation (art. 6.1.c GDPR).
- To send commercial communications you expressly request: consent (art. 6.1.a GDPR), which you may withdraw at any time.
We do not carry out automated decision-making or profiling with legal effects on you.
4. How long we keep it
- Enquiries that do not lead to a business relationship: up to one year from the last contact.
- Business relationship: for as long as it is in force and, afterwards, for the limitation periods of any resulting claims.
- Commercial and tax records: six years under the Spanish Commercial Code and four years under tax rules, from the close of the relevant financial year.
After those periods the data is deleted or blocked so that it remains available only to courts and competent authorities.
6. International transfers
Our activity runs between Spain and China. To carry out an operation it may be necessary to share professional contact details with our subsidiary, our team or partners located in China, a country without an adequacy decision from the European Commission.
Where that happens, it relies on one of the safeguards in Chapter V GDPR: standard contractual clauses approved by the European Commission, or the fact that the transfer is necessary to perform a contract or pre-contractual measures requested by you (art. 49.1.b GDPR).
You may ask us about the safeguards applied, and obtain a copy of them, through the contact email address.
7. Obligation to provide data, and its source
The fields marked as required in our forms are necessary to attend to you: without them we cannot answer your enquiry or prepare a proposal. The rest is voluntary and only helps us give a better answer.
Where we do not obtain the data directly from you, it comes from publicly accessible professional sources, from trade fairs and sector events, or from the company you work for, and is limited to professional contact details.
8. Your rights
You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability at any time, and withdraw any consent given without affecting the lawfulness of prior processing.
To do so, write to advance@advancetradingsolutions.com or to our registered office, stating the right you wish to exercise and enclosing a copy of a document proving your identity. We will reply within one month, extendable under article 12 GDPR.
If you believe your request has not been handled properly, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es, C/ Jorge Juan 6, 28001 Madrid).
9. Security
We apply technical and organisational measures appropriate to the risk: access control, HTTPS encryption of the site's communications, backups, and confidentiality commitments from staff and providers. No system is invulnerable, so absolute security cannot be guaranteed.
10. Minors
This site is aimed at professionals and companies. We do not knowingly process data of children under fourteen. If we find such data has been provided, we will delete it.
11. Changes to this policy
We may update this policy to reflect legal or operational changes. The date of the last update appears at the top of the document.
